What’s the Difference Between Economic and Non-Economic Damages?

Maurer Law Team

When an injury occurs due to an accident, compensation may be available. This compensation typically falls into two categories: economic and non-economic damages. Knowing the difference can help individuals understand what they can claim and why it matters, especially when seeking fair recovery.

What are economic damages?

Economic damages refer to financial losses directly caused by the injury. These include medical expenses, lost wages, and property damage. Any cost that has a clear, calculable amount fits into this category. For example, medical treatment bills or repair costs count as economic damages. Lost wages from missing work due to recovery also qualify, as do any future income losses if the injury limits someone’s ability to work long-term.

These damages are often easier to calculate because they are backed by receipts and other concrete evidence.

What are non-economic damages?

Non-economic damages are harder to measure because they don’t have a specific monetary value. These damages cover things like pain and suffering, emotional distress, loss of enjoyment of life, and loss of companionship. Though it’s impossible to assign an exact dollar amount, they still play a significant role in compensation.

Non-economic damages recognize how an injury affects an individual’s overall well-being, beyond just physical or financial harm. They aim to address the personal and emotional impacts that often go unrecognized but still carry weight in the healing process.

Why do they matter?

Economic and non-economic damages both aim to compensate the injured party, but they address different aspects of harm. Both economic and non-economic damages, along with other punitive damages, play a large part in ensuring fair compensation after an accident. The combination of these damages ensures that all forms of harm are acknowledged.

While financial losses are easier to measure, the emotional toll of a personal injury is just as important. Recognizing both types of damages gives a fuller picture of what someone truly faces after an accident.
